MULGRAVE — Mulgrave town council has appointed an outside investigator in an unspecified legal matter involving “litigation” or “potential litigation” following an hour-long closed-door session Monday night (March 17).
After reconvening in public chambers briefly, council passed a motion – moved by Deputy Mayor Joanne Maas Latimer and seconded by Councillor Jane Tate – naming MC Advisory Group Inc. as the investigator under the Municipal Government Act’s (MGA) Code of Conduct for Municipal Elected Officials.
When asked, Chief Administrative Officer David Gray confirmed that the appointment related specifically to the third item on the meeting’s “in-camera” agenda – litigation or potential litigation – and not to the first item, which specified “alleged breaches of the municipality’s code of conduct.” That, he said, was a separate issue.
He declined to elaborate on either issue, adding: “What I can say about the first item is that there is nothing that will be circulated about [it].
Officials would not confirm whether the first issue remains active. “It’s an in-camera conversation,” Mayor Ron Chisholm said.
According to the MGA, Section 22(2) outlines specific matters that a municipal council or its committees may discuss in closed sessions. The relevant clauses are Clause (da), “alleged breaches of the municipality’s code of conduct and Clause (f), “litigation or potential litigation.” These provisions allow councils to address sensitive issues privately, ensuring confidentiality in matters such as code of conduct violations and legal proceedings.
